Terms of Use

These Terms of Use (the "Terms") govern your use of the EditorAI application and related services (the "Service"), provided by FORB LABS, S.L. By downloading, installing or using the App you accept these Terms. If you do not agree, do not use the Service.

1. Provider

FORB LABS, S.L. (Sociedad Unipersonal), NIF B93833242, registered office at C/ Francisco Benedito Roda 29, 30510 Yecla (Murcia), Spain, registered with the Mercantile Registry of Murcia (1st entry dated 22 July 2026). Email: contact@editorai.me. Referred to as "we", "us" or the "Provider".

2. Definitions

• App: the EditorAI application for iPhone.
• Service: the App, our servers, the automatic editing and the websites operated by us for EditorAI.
• You or User: the person using the Service.
• Your Content: videos, audio, scripts and any other material you record, import or create with the App.
• Edit: one run of the automatic editing on a video you choose.
• Subscription: a paid plan purchased through the App Store (Starter, Pro or Ultimate, monthly or annual).
• Minutes: the unit in which Edits are measured under section 9.

3. Relationship with Apple's licence

The App is licensed to you, not sold. Your use of the App is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms supplement it. If there is a conflict regarding the App's licence, the Standard EULA prevails over these Terms only to the extent required by Apple's rules; on everything else, these Terms apply. Section 23 contains terms required by Apple.

4. The Service

EditorAI helps you edit videos in which people talk to the camera. You record or pick a video; the App sends only its audio to our server, which uses third-party speech-recognition and artificial-intelligence services to find repeated takes, long pauses and filler words; the App then shows a suggested cut that you can review and adjust (swap takes, restore lines, trim clips) before saving it to your Photos library. The App also includes a camera with a teleprompter and local drafts. A detailed description of how data is processed is in the Privacy Policy.

We may improve, change or remove features to keep the Service working, secure and up to date. We will not remove the core functionality of a plan you have paid for during a period already paid.

5. Eligibility

You must be at least 16 years old (or the higher minimum age of digital consent in your country) to use the Service. If you are under 18, you may only purchase a Subscription with the consent of a parent or guardian. By using the Service you confirm that you meet these requirements and have the capacity to accept these Terms.

6. No accounts; your device

The Service does not require an account. The App creates a random identifier on your iPhone to apply your plan and limits and uses Apple's App Attest to prove that requests come from the genuine App. Your Subscription is linked to your Apple ID through the App Store; to use it on another iPhone, install the App and tap Restore Purchases. Moving a Subscription to a new iPhone this way may move it away from the previous one. You are responsible for your device, its security and for any use of the App on it.

7. Free edit

Without a Subscription you may use the App's camera, teleprompter and drafts and try one free Edit per device, on a video of up to 90 seconds. Saving or exporting the edited video requires a Subscription. We may limit the number of free Edits per network or per day to prevent abuse, and change or end the free Edit at any time. The free Edit is a demonstration and is provided "as is".

8. Subscriptions

8.1 Plans and prices

The plans, their prices in your currency, their billing period and what each includes are shown in the App before you buy. Prices include the taxes applicable in your App Store country. The price shown on the purchase screen and confirmed by Apple is the price that applies.

8.2 Payment

Purchases are made exclusively through Apple's App Store, under Apple's terms. Payment is charged to your Apple ID at confirmation of purchase or, if you start a free trial, when the trial ends. We never receive your payment details.

8.3 Free trial

New subscribers may be offered a free trial of 3 days, as indicated on the purchase screen. During the trial you may edit up to 10 minutes of video; the plan's full allowance applies once the Subscription is paid. The App shows the date on which the paid plan, and its full allowance, begin. Unless you cancel at least 24 hours before the trial ends, the Subscription starts automatically and the plan's price is charged. Free trials are available once per Apple ID per subscription group, as determined by Apple. If you cancel during the trial, you keep access until it ends.

8.4 Automatic renewal

Subscriptions renew automatically at the end of each monthly or annual period, at the price then in force, unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within the 24 hours before the end of the current period.

8.5 Managing and cancelling

You can manage or cancel your Subscription in your iPhone's Settings → your name → Subscriptions, or from Settings → Manage Subscription in the App. Deleting the App does not cancel the Subscription. After cancelling you keep access until the end of the period already paid.

8.6 Upgrades and downgrades

You can change plan from the App. Apple applies upgrades immediately and prorates the remaining period; downgrades and changes of billing period take effect at the next renewal.

8.7 Refunds

Refunds are handled by Apple under its policies (reportaproblem.apple.com). We cannot issue refunds for App Store purchases.

8.8 Right of withdrawal (EU and UK consumers)

The Service is digital content and a digital service supplied immediately. In accordance with Article 103(m) of the Spanish consolidated General Law for the Protection of Consumers and Users (Royal Legislative Decree 1/2007) and equivalent provisions, by starting the Subscription or the free trial you expressly request that the Service begin immediately and acknowledge that you lose the right of withdrawal once it begins, without prejudice to Apple's refund policies and any non-waivable right under the law of your country.

8.9 Price changes

We may change the price of a Subscription. Apple will inform you in advance and, where required, ask for your consent before the new price applies to your renewal. If you do not accept, you can cancel before the renewal.

9. Usage limits

Each plan includes an amount of video that can be edited, measured in Minutes. The limits in force are shown in the App before purchase and in Settings, and are currently:

• Each Edit counts the length of the video in whole seconds, with a minimum of 30 seconds per Edit. Videos may be up to 5 minutes long.
• The monthly period counts from the first time the App connects to our server and renews every month. The day follows UTC.
• Unused Minutes do not roll over and have no cash value.
• If an Edit fails for reasons attributable to us, the Minutes are returned automatically. An Edit is counted according to the real duration of the audio.
• These limits exist to keep the Service sustainable and fair and to prevent abuse. We may adjust them for future periods with reasonable notice in the App; changes will not reduce a period you have already paid for.

10. Your content

You keep all rights to Your Content. We do not claim ownership of it. To provide the Service you grant us, for the sole purpose of performing the Edits you request, a limited, non-exclusive, worldwide, royalty-free licence to transmit the audio of your videos to our servers and processors and to process it, and to return the result to you. This licence ends when the Edit is completed; we do not store your audio or transcripts and do not use Your Content for advertising or to train artificial-intelligence models.

You are solely responsible for Your Content and represent that: (a) you own it or have all necessary rights, licences and permissions, including from any person who appears or can be heard in it, and from the owners of music or other material it contains; (b) it complies with the law and with these Terms; and (c) its processing as described does not infringe the rights of third parties (including image, privacy, data protection and intellectual property rights).

11. Acceptable use

You agree not to:

• use the Service for illegal purposes or to create or edit content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, that infringes the rights of others, or that incites violence;
• edit recordings of people made without their consent where consent is legally required;
• circumvent or attempt to circumvent usage limits, the free Edit, App Attest, payment or other technical measures, including by creating multiple identifiers, resetting devices, modifying the App or using emulators;
• access the Service by automated means, scripts or bots, or other than through the genuine App;
• copy, decompile, reverse engineer, disassemble or create derivative works of the App or our servers, except to the extent the law expressly allows it;
• interfere with, overload or attack the Service, its infrastructure or providers, or test their vulnerabilities without our written permission;
• resell, sublicense or make the Service available to third parties as a service;
• use the Service to develop a competing product or to extract data or models.

Breach of this section may lead to suspension or termination under section 17 and to the actions permitted by law.

12. AI results

Edits are generated automatically by artificial intelligence and are suggestions. They can be wrong: a good line may be removed, a mistake may remain, or a take may be chosen that you would not choose. Always review the result before saving or publishing it. You are responsible for the final video you save and publish. Speech recognition may be less accurate with background noise, several speakers, strong accents or certain languages.

13. Versions and platform rules

The App lets you create different versions of the same recording by choosing different takes. We do not guarantee that any version will be treated as original, unique or free of duplicate-content, copyright or other claims by any platform (such as TikTok, Instagram or YouTube), nor that it will reach any audience or result. You are responsible for complying with the rules of the platforms where you publish, including rules on duplicate content, sponsored content and advertising disclosure, and with the rights of third parties.

14. Third-party services

The Service relies on third-party providers (such as Apple, Cloudflare, Supabase, Deepgram, Anthropic and RevenueCat). We are not responsible for services, websites or content of third parties that are not under our control, including platforms where you publish your videos. Links to third-party websites are provided for convenience.

15. Our intellectual property

The App, its software, design, interface, texts, graphics, logos, the name EditorAI and all related intellectual and industrial property belong to FORB LABS, S.L. or its licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, as permitted by the Standard EULA. No other rights are granted.

16. Feedback

If you send us suggestions or comments, you allow us to use them freely to improve the Service, without obligation to you, and we will treat any personal data in them under the Privacy Policy.

17. Changes, suspension and termination

You may stop using the Service at any time by deleting the App and cancelling your Subscription. We may suspend or restrict your access, with notice where reasonably possible, if you seriously or repeatedly breach these Terms, if required by law or an authority, or to protect the Service or other users from fraud or abuse. We may discontinue the Service with at least 30 days' notice in the App; in that case, where you have paid for a period that cannot be provided, you may request a refund from Apple, and we will support such requests. Sections 10 (second paragraph), 11, 15, 18 to 20, 25 and 26 survive termination.

18. Warranties

We will provide the Service with reasonable care and skill. Except as expressly stated in these Terms and to the extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of the AI results or uninterrupted, error-free operation. Nothing in these Terms limits the legal guarantees of conformity that consumers have under applicable law (in Spain, Title IV of Book II of Royal Legislative Decree 1/2007), which are not affected.

19. Liability

We are not liable for: loss of views, followers, income, business or opportunities; claims by platforms or third parties arising from Your Content or from videos you publish; loss of content caused by deleting the App, your device or projects (keep copies of your originals); or indirect or consequential damage. To the extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. These limitations do not apply to liability for fraud, wilful misconduct or gross negligence, for death or personal injury, or to any liability that cannot be limited or excluded under the law of your country, including consumer law.

20. Indemnity

To the extent permitted by law, you will indemnify us against claims by third parties arising from Your Content or from your breach of these Terms or of the law, including reasonable legal costs. If you are a consumer, this section applies only where the claim results from your wilful or negligent conduct.

21. Force majeure

We are not responsible for failures or delays caused by events beyond our reasonable control, such as outages of third-party providers, networks or energy, cyber-attacks, natural disasters, pandemics, strikes or acts of authorities.

22. Privacy

We process personal data as described in the Privacy Policy, which forms part of these Terms for information purposes.

23. Apple terms

You and we acknowledge that:

• these Terms are concluded between you and FORB LABS, S.L. only, and not with Apple Inc. ("Apple"); we, not Apple, are solely responsible for the App and its content;
• your licence to use the App is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you via Family Sharing or volume purchasing;
• we are solely responsible for providing maintenance and support for the App; Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App;
• we are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility;
• we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation;
• in the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim;
• you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties;
• you must comply with applicable third-party terms of agreement when using the App (for example, your mobile carrier's terms);
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

24. Changes to these Terms

We may update these Terms to reflect changes in the Service, our plans or the law. We will publish the new version with its date and, if the changes are significant, notify you in the App at least 15 days before they take effect. If you do not agree, you may stop using the Service and cancel your Subscription before that date; continuing to use it afterwards means you accept the new Terms. Changes do not apply retroactively to periods already paid.

25. Law and disputes

These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings before the courts of your domicile, as provided in Regulation (EU) No 1215/2012 and the Spanish consumer protection law. If you are not a consumer, the courts of Murcia (Spain) have exclusive jurisdiction. Before going to court, please contact us: we will try to resolve any complaint within 30 days. We are not obliged to, and do not, participate in dispute resolution proceedings before a consumer arbitration board, without prejudice to your right to go to them or to the competent consumer authorities.

26. General provisions

If any provision of these Terms is held invalid, the rest remain in force and the invalid provision will be replaced by a valid one closest to its purpose. Our failure to enforce a right is not a waiver. You may not assign your rights under these Terms without our consent; we may assign them to a successor in the business, without reducing your rights. These Terms, together with the Privacy Policy and the Standard EULA, are the entire agreement between you and us regarding the Service.

27. Language

These Terms are written in English. If we provide a translation, the English version prevails.
